THE IMPLICATION OF DIGITAL SURVEILLANCE LAWS ON THE PRIVACY OF INDIVIDUALS AND SOCIAL DYNAMICS IN INDIA

Abstract

The fast growth of digital technologies has greatly changed social relations, politics and legislations across the world. Digital surveillance mechanisms that have been implemented in India have brought up very fundamental concerns about the balance between the country security, societal order and personal privacy rights. This study reviews the legal provisions that regulate the digital surveillance in India, their social consequences, and the difficulty in protecting privacy and ensuring law enforcement. This paper uses a doctrinal legal method and social science point of view with a view to discussing high-profile decisions, legislative policies and how they impact society in terms of belief in trust, independence and freedom. The results suggest that legal action is supposed to ensure national security and benefit the wellbeing of the population, however, the weak legal protection, as well as the uncertainty in the statute, have led to societal fear and mistrust towards the use of digital technology, and the decrease in privacy standards. The research paper ends by proposing an integrated response to the laws, openness pertaining to surveillance activities, and involvement with people to bolster the trust of the citizens in online governance.
