A Critical Analysis on The Increasing Trend on Custodial Violence in India

Abstract

This paper investigates the effects of India's growing tendency of incarceration violence. In today's culture, there has been a sharp rise in the prevalence of custodial violence. According to some, the purpose of custodial violence is to demonstrate or reinforce a person's sense of dominance or authority when they are in the care of law enforcement. As they say, "Absolute power corrupts absolutely"—"power tends to corrupt" The present study employed the random sample approach with a special focus on the general population. Two hundred samples were drawn from the general population. According to this research, the public believes that there is a rise in custodial violence in society and that the arrested person should have appeared before the magistrate within 24 hours. They also believe that torturing an arrested person while in custody is a flagrant violation of their human rights and that police officers receive the necessary training to handle these situations. The police need to be re-educated by the government to respect human dignity and to abandon their cruel practices.
