Abstract

This study strikes to deal with precautionary criminal policy in Iraq to deal with crimes against public ethics, through descriptive and legal basis on which it is founded, and enlightening its efficiency in defending ethical and social tenets and maintaining public order. It also seeks to balance the necessities of defending public ethics and ensuring constitutionally confirmed individual rights and liberties. The study depend on on the descriptive analytic method by reviewing and examining Iraqi legal texts in relation to to crimes against public morals, in addition to the comparative approach to legislative practices, as well as the critical method to assess the current defensive measures and propose suitable resolutions. The study stretched a set of outcomes, most particularly: that defensive policy is more efficient than disciplinary alone in reducing these crimes; that Iraqi legal texts, although comprehensive, sometimes suffer from generalization and vagueness; that weak organizational management between the experienced establishments reduces the efficiency of protective strategy; as well as the effect of technical expansions that contributed to the development of descriptions of crimes against public ethics.
